Master Commissioner Auction TERMS:  Under and by virtue of a JUDGMENT AND ORDER OF SALE made and entered upon the records of the Bourbon Circuit Court, on the 5th day of June, 2024, in action Claude Wilson Dean and Elizabeth Stone Woodruff , his wife; Jo Allen Gause and John Pancoast, her husband; John Jowph Earls, a single person; Mary Elizabeth Bohannon and David L. Bohannon, her husband VS. Anne Maxwell Fisher Yearians and Henry Allen Yearians, her husband, et.at. Bourbon Circuit Court Division II Case No. 24-CI-00056; therein pending, the undersigned Special Commissioner, Anna Johnson, will sell at public auction to the highest and best bidder 427 Clay Kiser Road, Paris Kentucky, at or about the hour of 10:00AM prevailing time, on September 14, 2024, the following described property, to-wit: Property located at 427 Clay Kiser Road, Paris KY 40361. Said sale will be made upon terms of a down payment of ten percent (10%) by certified or cashier’s check or other verifiable and collectible medium of exchange acceptable to the Commissioner and the balance on credit of thirty (30) days with purchaser giving bond with good surety for the balance of the purchase price, and with the further provision that the purchaser will have the privilege of paying cash therefore on the date of said sale. Said bond shall be payable to the undersigned Special Commissioner and shall bear interest at the rate of 12% per annum, from the date of sale until paid, and a lien will be retained in said bond on the property so sold as a further security for the payment of purchase price. The purchaser of said property shall be required to pay or assume all taxes or assessments upon the property for 2024 and any such taxes and assessments for all subsequent years. Unpaid taxes, if any for prior years, will be paid out of the proceeds of the sale, if properly claimed in writing and filed in the record by the purchaser prior to payment of purchase price. Said property shall be sold subject to all easements and restrictions of record in the office of the Clerk of the Bourbon County Court, all zoning and health regulations of the County of Bourbon, and Commonwealth of Kentucky, and any facts which an inspection and accurate survey of said property may disclose.  Said property shall be sold free and clear of all liens and encumbrances and any other right, title and interest of the parties to said above captioned legal action.
